Alamogordo Code of Ordinances Article 12-02. Code Adopted
12-02-010. Generally-International Fire Code Adopted. (a) With the exception and amendments set forth below, the city herby adopts by reference the conditions, provisions, limitations and terms of the International Fire Code, 2003 Edition, published by the International Code Council, including any amendments thereto which are adopted by the state as of the date of or the subsequent to the date of this section.
International Fire Code Requirements
307.1 General. A person shall not kindle or maintain or authorize to be kindled or maintain any open burning unless conducted and approved in accordance with this section.
307.2 Permit required. A permit shall be obtained from the Alamogordo Fire Department prior to burning. Application for such approval shall only be presented by and permits issued to the owner of the land upon which the open burning is to be conducted.
307.2.1 Authorization. Where required by the State or local law or regulations, open burning shall only be permitted with prior approval from the state, or local air and water quality management authority along with the Alamogordo Fire Department, provided that all conditions specified in the authorization are followed. Note: Notification and approval from the adjacent property owner must be completed prior to the return of the permit to the Alamogordo Fire Department.
307.2.2 Prohibited open burning. Open burning that is offensive or objectionable because of smoke or odor emissions or when atmospheric conditions or local circumstances make such fires hazardous shall be prohibited. The Alamogordo Fire Department is authorized to order the extinguishment by the permit holder which creates or adds to a hazardous or objectionable situation.
307.3 Location. The location for the open burning shall not be less than 50 feet from any structure owned by or in the possessory control of that property. Burning shall be conducted at least 300 feet from any occupied dwelling, workplace, or place where people congregate, which is on the property owned by, or under possessory control of another person.
307.4 Attendance. Open burning shall be constantly attended until the fire is extinguished. A minimum of one A,B,C portable fire extinguisher with a minimum 4-A rating or two 2.5 gallon water type extinguishers or other on site fire extinguishment equipment, such as dirt, sand, water barrel, garden hose or water truck, shall be available for immediate utilization.
